Terms of Use

These Terms of Use (the “Terms”) govern the relationship between individual Ilya Igorevich Tovstogray (the “Administration”) and the user (the “User”) when using the giftdeck.xyz website and the GIFTDECK service (the “Service”). Beginning to use the Service means full and unconditional acceptance of these Terms.
1. Subject
The Service is a free informational platform that helps Users organize the exchange of games (gifts) on Steam: an anonymous “Secret Santa”, public gifts, themed events, and free giveaways. The Service is entertainment in nature and is provided on an “as is” basis.
2. Status of the Administration and delivery of gifts
The Administration organizes informational interaction between Users and is not a party to the gift transactions between them. Within the meaning of Art. 1253.1 of the Civil Code of the RF, the Administration acts as an information intermediary: it merely transmits Users' materials without initiating the transfer or determining its content. The Administration does not accept, hold, or transfer funds, does not act as an intermediary in settlements, and does not profit from the exchange. Gifting a game (handing over an activation key) is a gratuitous transaction between Users (Ch. 32 of the Civil Code of the RF); the Service merely provides the tools for it.
2.1. Ways to deliver a gift. The gifter chooses the delivery method themselves:
- Via Steam — the gifter gifts the game through Steam directly to the recipient. This may require adding the recipient to the Steam friends list, so the gifter's anonymity is not guaranteed in this case.
- By key (anonymously) — the gifter, on their own and at their own expense, acquires a game activation key from any source available to them and hands it to the recipient through the Service's secure channel. The key is stored in encrypted form, is not disclosed to anyone but the recipient in the Service's normal operation, and is deleted after the exchange is completed. No funds pass through the Service in this process.
2.2. Confirmation of receipt. With key delivery, the fact that the recipient reveals (displays) the key is recorded by the Service and is deemed confirmation of receipt of the gift. Revealing is irreversible.
2.3. Responsibility for the key. By handing over a key, the gifter confirms that the key was acquired lawfully and that the gifter is entitled to dispose of it. The Administration does not acquire, sell, or verify keys, does not guarantee their functionality, validity, or regional availability, and is not responsible for the result of activation. Using the Service to hand over keys obtained unlawfully, keys belonging to others, or already-used keys is prohibited.
2.4. Group pools.The Service lets a User (the «Organizer») announce an intention to pool money for a single gift and post a link to a third-party collection service opened by the Organizer in their own name. The Administration does not accept, hold, transfer, or retain those funds, does not verify the declared amounts, their receipt, or how they are spent, charges no fee, and is not a party to the settlement between the Organizer and the participants. Funds are transferred by participants to the Organizer directly, voluntarily, and at their own risk. The obligation to buy and deliver the gift is owed by the Organizer to the participants, not to the Administration. Disputes over transferred funds are resolved between the Organizer and the participants; the Administration does not arbitrate them and issues no refunds. Amounts shown in the Service’s interface are Users’ own statements and are not verified by the Administration.
2.5. Invitations. The Service lets a User invite others via a personal link. An invitation counts only after the invited person has themselves delivered a gift to another User and receipt has been confirmed. Rewards for invitations are purely internal (wheel attempts, days of GIFTDECK+ access), have no monetary value, cannot be exchanged for money, and are not remuneration for work or under any contract. Invitations create no employment, agency, or other paid relationship between Users and the Administration. Creating accounts to inflate invitation counts is prohibited and results in cancelled rewards and a ban.
3. Registration, sign-in, and access
- to use the Service, the User creates an account on the Service — by choosing a username and password. Sign-in (authorization) is performed by the Service itself using the username and password; sign-in via Steam is not used (part 10, Art. 8 of Federal Law No. 149-FZ of 27.07.2006);
- the password is stored only as a cryptographic hash, is not known to the Administration in plaintext, and is not requested by it; the User must keep their username and password secret and is responsible for their safekeeping;
- the Steam profile is linked after sign-in — it is needed for the game features (gifting, wishlist, checks) and confirms that the profile belongs to the User via the Steam OpenID protocol; the Steam password is not transmitted to the Administration;
- email and phone are not used. Therefore, if the username or password is lost, the only way to recover access is to create a new account and re-link your Steam to it: the data of the former account is transferred to the new one, and the former is deleted (no more than once every 7 days). If the User also loses access to Steam, recovery will be impossible — keep your username and password safe;
- the Service may be used by persons who have reached 18 years of age;
- the User undertakes to provide accurate data, not to impersonate others, and not to create multiple accounts to circumvent restrictions;
- the User is responsible for actions taken under their account.
4. Rules of conduct
When using the Service, including chats and messages, it is prohibited to:
- violate the laws of the RF or the rights and interests of third parties;
- post insults, threats, spam, fraudulent schemes, or malicious links;
- distribute prohibited content, including content inciting hatred, pornographic, or extremist content;
- attempt to circumvent the mechanisms of security, matching anonymity, and giveaway fairness;
- hand over through the Service activation keys obtained unlawfully, as well as keys belonging to others or already-used (activated) keys;
- use the Service for trade, exchange with a monetary surcharge, or other commercial activity not envisaged by the Service.
5. Comments on gifts
Users may leave comments on gifts shown in the public feed. A comment is published under the User’s account and is readable only by Users signed in to the Service; visitors who are not signed in see only the comment count. A comment is posted voluntarily and at the User’s own discretion; the User is solely responsible for its content.
- links in comments are prohibited; submissions containing links are not accepted;
- the rules of Section 4 of these Terms apply to comments in full;
- a comment may be deleted by its author, by the participants of the relevant gift (the giver and the recipient), and by the Administration. A User may delete their own comment at any time;
- unlike chat messages, comments are stored indefinitely — until deleted by the User or the Administration, or until the author’s account is deleted;
- upon deletion of an account, and likewise upon its blocking, all of that User’s comments are deleted;
- a User may report a comment. When a report is filed, a copy of the comment’s text is retained for the handling of that report and is deleted once it is closed.
6. Moderation and blocking
The Administration may restrict access, hide content, and block accounts that violate the Terms, without prior notice. Upon blocking, the profile and associated data may be deleted. Messages are stored for a limited time and may be viewed for moderation purposes (see the Privacy Policy). Comments that violate the law or these Terms are deleted, including upon the request of an interested party or the demand of a competent authority.
7. Giveaways and the “Wheel”
Free giveaways and spins of the “Wheel” are conducted under the Giveaway & Wheel Rules. Participation is free; results are determined by a verifiable (provably-fair) algorithm.
8. Intellectual property
The name, design, program code, and other elements of the Service belong to the Administration. Game images and titles belong to their rights holders and are used solely for informational purposes.
9. Disclaimer of warranties and limitation of liability
- the Service is provided “as is”; the Administration does not guarantee uninterrupted operation or the absence of errors;
- the Administration is not responsible for the actions of Users, including for gifts that were not sent, not received, or did not meet expectations;
- the Administration does not verify activation keys and does not guarantee their functionality, validity, or regional availability; disputes about a non-working key are considered where possible, taking into account Users' reputation and history, but without any obligation of the Administration to reimburse the cost of the gift;
- the Administration is not responsible for the operation of third-party services (Steam, payment services);
- the User uses the Service at their own risk and bears sole responsibility for their actions.
To ease situations where a gift did not arrive, the Service provides a “rescue” gift mechanism; however, it is not a guarantee and depends on the voluntary participation of other Users.
10. Changes and termination
The Administration may change the Terms and the functionality of the Service, and may suspend or terminate the Service. The current revision is available at https://giftdeck.xyz/legal/terms. Continued use of the Service after changes means acceptance of them.
11. Governing law and dispute resolution
The Terms are governed by the law of the Russian Federation. Disputes are resolved through negotiation, and, failing agreement, in accordance with the laws of the RF. For any questions: foreign.tubers@gmail.com.
